Is NYCERS disability pension taxable?

By law, each year, every retiree receiving a disability retirement ben- efit from NYCERS may be required to be re-examined by NYC- ERS’ Medical Board. Disability retirement benefits for Tier 3 and Tier 4 members are not subject to New York State and local income taxes. They are, however, subject to Federal income tax.

What is article 15 disability retirement?

To qualify for an Article 15 disability retirement benefit, you must have at least ten years of credited service, unless your disability results from an accident you sustain on the job.

How is a disability pension calculated?

Your retirement benefit is calculated using a formula with three factors: Service credit (Years) multiplied by your benefit factor (percentage per year) multiplied by your final monthly compensation equals your unmodified allowance.

Is New York State Disability retirement taxable?

If you received a pension payment from New York State, local government, the federal government (including SS benefits) or from certain public authorities, it is not taxable in New York.

What is ordinary disability retirement?

If you are unable to perform your duties because of permanent physical or mental incapacity, and have ten or more years of service credit, you may be eligible for an ordinary disability retirement benefit.
